Marieke Spee

Senior Associate

Marieke Spee is an attorney (senior associate) specializing in financial regulatory law. Marieke has extensive transactional and advisory experience in the areas of banking, finance, and financial regulatory law.

As part of Finnius’ asset management team, Marieke assists financial institutions with matters related to the AIFMD, UCITS, EuVECA, ELTIF, PRIIPs, and MiFID II. Her work includes addressing scoping queries, license applications and registrations, assessing and advising on the impact and implications of regulatory requirements in fund documentation, addressing requirements arising from anti-money laundering regulations and sanctions legislation (Wwft and Sw), and ongoing supervisory requirements. She also has extensive experience with drafting and reviewing fund documentation for investors. Her clients are primarily active in private equity, venture capital, real estate, health (tech) and impact investments. Furthermore, within Finnius, Marieke is involved in advising trust offices, EGIs and payment service providers on qualification queries and topics such as outsourcing, conflicts of interest, risk management and compliance, and screening assessments. In her day-to-day practice, Marieke also places a special focus on sustainability regulations (SFDR, Taxonomy Regulation, and sustainability claims), working closely with her clients to help them understand the impact of the ever-evolving requirements in this field of law.

Marieke is an enthusiastic attorney with an inquisitive mindset, and she views the relationship with her clients as a key foundation for the assistance she provides. Marieke studied at the University of Groningen, where she earned her Master’s degree in Dutch law (specializing in Private Law and Business Law) and her Master’s degree in International Comparative Private Law. Marieke also spent a semester studying at Queen’s University in Kingston, Ontario, Canada. In 2021, Marieke completed the Grotius program in Financial Law. Marieke regularly publishes and teaches courses on topics related to her practice. She is also a guest lecturer at Radboud University.

  • Advice on general disclosure requirements (Wet OHP) and their implications for disclosure materials;
  • Regulatory structuring of investment funds, including the drafting and review of fund documentation and disclosure materials for fund managers or investors;
  • Registrations pursuant to the NPPR regime;
  • Assistance with and advice on cross-sectoral issues related to outsourcing, conflicts of interest (management), risk management and compliance, screening assessments and liquidity related queries, and their implementation within clients’ policy frameworks;
  • Advice on integrity issues (Wwft and Sw), as well as assistance with thematic investigations in this area; and

Marieke Spee has registered in the Register of Legal Practice Areas of the Netherlands Bar Association the legal practice area Financial Law.

This registration obliges Marieke to obtain ten training points in this field of law each calendar year in accordance with the standards of the Dutch Bar Association.
